SANDHUTTON APPEAL SUCCESS
Background
Richard Roberts partnered with a local farming family to promote a site without allocation for residential development, and with a former refusal of planning permission on it. This was on landscape and character, as well as ‘sustainability of the settlement’ grounds.

Richard Roberts prepared a robust case to seek to mitigate those issues previously voiced as reasons for refusal from the LPA.
The LPA refused to engage, and therefore Richard Roberts advised that they move directly to appeal without waiting for the LPA to determine the application, as there were significant policy movements just around date corner which would have made any permission more unlikely.
APPEAL
Our appeal was allowed with the inspector concurring with Richard Roberts on all counts and planning permission was granted in February 2021.
Richard Roberts’ strategy, considering policy timeframes and the strength of our argument meant we were able to overturn a previous rejection, as well as navigate a negative response from the Local Authority.
